Terms of Service
Effective Date: September 5, 2025
Company: Montage Studio LLC, California, USA
Contact: chris@montage.mov
These Terms set out how we work with you. By hiring Montage Studio LLC (“we,” “our”) for creative or production services, you (“you,” “client”) agree to the following:
1. Scope of Work
We’ll deliver the services agreed in your proposal or Statement of Work (SOW).
Quotes are valid for 30 days.
Work begins after written approval and receipt of any deposit.
If the project scope changes, we’ll update the budget and timeline together.
2. Payment
Invoices are Net 30 — payment is due within 30 calendar days of invoice date.
Larger projects may be billed in stages.
Late payments may incur a 5% monthly fee, and we may pause work until payment is received.
3. Confidentiality & Portfolio Use
Both sides agree to keep sensitive information private.
You own all raw footage and final deliverables unless agreed otherwise.
We may showcase selected completed work in our portfolio unless you ask us not to in writing.
4. What We Need From You
Clear, timely communication, approvals, and access to things like footage, internet, power, or venue passes.
If delays happen because of missing information or access, schedules and costs may change.
5. Revisions & Changes
Reasonable revisions are included as outlined in the project scope.
Major changes or new requests will be agreed in writing and may adjust fees or deadlines.
6. Cancellation & Termination
Either side may end the project with 30 days’ written notice.
Serious breaches can lead to immediate termination.
Work completed up to the end date must be paid for.
Deposits are non-refundable if the project is cancelled within 30 days of start or if significant work has already been done.
7. Liability
We’re not responsible for indirect losses such as lost profits or reputation.
Our total liability is capped at the amount you’ve paid us.
We can’t guarantee results that depend on third parties (e.g., AV teams, venues, platforms).
8. Events Outside Our Control
We’re not liable for delays caused by things outside our control (e.g., natural disasters, illness, power or internet outages).
9. Live Events & Editing
We’ll provide crew and editing infrastructure as agreed.
You’re responsible for venue access, credentials, and reliable power/internet.
We can’t guarantee uninterrupted service if venue conditions fail.
Extra editing or urgent turnaround beyond scope may be billed at our day rate.
10. Documentary & Live Action Productions
For projects such as documentaries, brand films, or other scripted/unscripted productions, we’ll supply crew, equipment, and production management as outlined in your SOW.
Shoot days are typically billed on a 10-hour day rate; overtime may apply if days run longer.
The client is responsible for providing required releases, approvals, and access to locations, talent, and any third-party materials.
We cannot be held responsible for delays or cancellations due to weather, location restrictions, or other circumstances outside our control; rescheduling may result in additional costs.
Final delivery timelines depend on both production and post-production schedules, and may shift if approvals or materials are delayed.
11. File Delivery & Storage
Unless otherwise agreed, we’ll deliver files promptly upon completion (e.g., within one business day of an event or as scheduled for longer productions).
Long-term storage of raw or finished files is your responsibility unless we agree otherwise.
12. Governing Law
These Terms are governed by the laws of California, USA. Any disputes will first be handled through good-faith discussions, and if needed, resolved in California courts.
Acceptance
By working with Montage Studio LLC, you confirm you’ve read and agreed to these Terms.
